To Whom It May Concern,
After listening to San Diego County District Attorney Bonnie Dumanis on KUSI this morning, I went to the County of San Diego District Attorney web site, expecting to find a way to report improper behavior on the part of the San Diego Sheriff's Department.
Instead, it says they (the "local police") are the ones to contact, or the "responsible investigating agency."
Who would that be for the following:
1) On November 25th, 2005, about 8:30 pm in San Marcos, California, then-Congressman Randall "Duke" Cunningham attempted to smash the car he was driving in at high speed head-on into the one I was driving. It was a very earnest suicide attempt, which failed because I had recently learned, from a local public service video produced in cooperation with the Carlsbad Police Department, exactly how to avoid such an attack, and, by the grace of God, was able to "pull it off." In fact, Sheriff Kelleher claimed on the phone that if it really was Cunningham trying to do that, he didn't think I could have avoided him. And he would have been right, were it not for that precise training I had received. It took me months to remember WHERE I had learned it, but the video is readily available locally and you can see for yourself. Without it, my wife, Cunningham, and I would all be "goners."
2) The San Diego Sheriff's Department has AGGRESSIVELY destroyed all possible evidence that could be used to indicate the severity of the criminal behavior and that might connect the hit-and-run accident with the perpetrator. They have attempted to intimidate my wife and me. They violated not only their oaths, but standard police procedure, time and again, and do nothing now but try to cover up what they have done.
We have already contacted the FBI, because we believe an FBI agent came up to us about a half hour after the accident, while we were waiting for a PROPER police response, and pretended to be a "good Samaritan." When I complained about this to the FBI by phone, I was told "we police our own." My wife's letters to the FBI have gone unanswered, except Washington told us to contact the local office -- the very office we were complaining was in collusion with the local cops that night!
We have sent a number of letters about the incident to Judge Burns, U.S. Attorney Lam (while she was still the local district's US Attorney), the IG of the DoJ, our Congresspeople, including Cunningham's successor, and the AG of CA. Yet Cunningham, right now, must surely believe he has gotten away with attempted murder, not by luck, but by the cooperation of his "friends." That's how things STILL stand even after all that effort! And every one of those I've contacted, undoubtedly wonders what REALLY happened.
Well, what really happened should be officially documented. Instead, the bigger the official, the bigger the lies we've gotten, if anything.
I believe District Attorney Dumanis has some authority, and therefore some responsibility, in this case. Cover-ups at ANY level ARE ILLEGAL. Aiding criminals operating under color of authority is especially unlawful and distasteful.
I have attached my response to Sheriff Kolender's IA investigation, which was finally sent to us months later than it was promised (why did it take so long?). I assume Ms Dumanis can review any and all of the SDCSD's internal documents in this case, or I will be happy to forward his office's original letter to us about the incident.
Please inform me why you believe the DA's office has no responsibility to solve this case of attempted murder in your district, by an obviously-temporarily insane individual, since its resolution rests ENTIRELY, at its root, with the corruption of the SDCSD, who gave the perpetrator preferential treatment that night, presumably to cover their own misbehavior following the attack.
